SEREMBAN: A 49-year-old man was sentenced to death by the High Court here for murdering his younger brother four years ago.

Judge Datuk Rohani Ismail ordered plantation worker K. Paramasivam to be sent to the gallows for the murder of his sibling who was then 44-years-old.

Paramasivam was charged with committing the offence between 11am and 1pm on June 8, 2020, at an oil palm plantation in Rantau.

He was charged under Section 302 of the Penal Code with murder.

In mitigation earlier, counsel for the accused Raftfizi Zainal Abidin said his client was remorseful and it was the first time he had run afoul of the law.

He also asked the court to use its discretion to impose a lengthy jail sentence instead of the death penalty.

Raftfizi said the accused had also confessed that he was intoxicated when he committed the crime.

Deputy public prosecutor Ala’uddin Baharom urged the court to impose the death penalty.

He said the accused had murdered a family member and that it was premeditated and brutal.

He said the accused had planned to kill his brother based on the 13 injuries found on the victim’s remains.

“The prosecution is asking for the death penalty and not a jail term as the victim, who was brutally killed, was the younger brother of the accused,” he added.
