Seven months after one Fardeen Vora Takhtiwala, 19, allegedly went missing from Dabhoi in Vadodara district after ‘attempting to elope’ with a minor girl from his neighbourhood, the Gujarat High Court on Thursday directed the Vadodara (rural) Superintendent of Police to supervise the probe into the case and find the teenage boy by July 11 – the date of the next hearing into the habeas corpus petition filed by his mother in February this year.
The Division bench of Justices Umesh Trivedi and CM Roy was hearing the habeas corpus petition filed by Fardeen Vora Takhtiwala’s mother Nasrinbanu Takhtiwala, who has alleged that the father of the girl “with whom the corpus was in love” has abducted her son on November 21. , 2023.
Making comments on the investigation carried out by the police, the Court said, “Except reports after reports filed, nothing fruitful is done by the inquiring officer into the missing complaint… From the papers of the inquiry conducted so far, we are unable to accept the manner in which the inquiry is going on… The statement of the girl, with whom the corpus last was, as also her father, appears to be in conflict with each other… There appear so many things untold in the two statements, which would have been effectively investigated by the IO. There appears to be no zeal to find out…”
The Court directed Vadodara SP Rohan Anand to supervise the inquiry and produce the corpus (Fardeen Vora Takhtiwala) before it by July 11. The Court said, “Therefore, SP Vadodara (Rural) is hereby directed to supervise the inquiry being conducted into the present case and see that in the right direction, the inquiry may proceed, with the correct conclusion. SP Vadodara (Rural) is directed to find out the corpus without fail and produce him before this court on or before July 11, 2024.”
In the petition, Nasrinbanu Takhtiwala has said that the family has been “regularly inquiring about the whereabouts of the corpus (Fardeen) but not yet received a satisfactory response, except mere hope, from officers of Dabhoi police station.” The petition is filed against the police inspector of Dabhoi Police Station, Vadodara Superintendent of Police, and the father of the minor girl with whom Fardeen Vora Takhtiwala was allegedly last seen on November 21, 2023.
Fardeen Vora Takhtiwala was an employee of a private company in Mundra in Kutch and was visiting his family during the holidays. The minor girl was a neighbor of his and according to the petition in the High Court, the two “were in love”. In the petition, Nasrinbanu Takhtiwala has said that on November 18 – three days before he went missing – Fardeen Vora Takhtiwala had been “attacked” by five or six persons in the Gopalpura area and had called up his brother Faizan Takhtiwala for help. “When the family members visited the said place, they found the corpus sitting near the bus stop and he was sent to his aunt’s home in Sankheda (in Chhota Udepur district)… on November 19. He returned to his house in Dabhoi (in Vadodara district).”
The petition further states that on the evening of November 20, Fardeen Vora Takhtiwala left the house at 5.30 pm on a scooter, informing his mother that he would “return in ten minutes”.
The petition states, “Thereafter, around 15 to 20 minutes later, the respondent (Father of the minor girl) visited the house (of Nasrinbanu) and informed that the corpus had run away with his daughter and threatened the petitioner and other family members to bring back his daughter within 12 hours… On the midnight of November 21, 2023, the neighbor of the petitioner was informed… that the (father of the minor) has left with his car in search of his daughter and Fardeen…”
The petition states that at 7.30 am on November 21, 2023, the father of the minor girl had called the father of Fardeen Vora Takhtiwala to his house, where his minor daughter was present. “The (father of the minor girl) handed over the mobile phone of Fardeen which was damaged and in response to the question about the whereabouts of the corpus, it was informed by the (father of the minor) that the corpus had left his daughter. and his scooter was lying near Gola Gamdi canal (in Sankheda taluka of Chhota Udepur district). The scooter was found there but the corpus could not be found…”
The missing person’s complaint in the case was registered at Dabhoi police station on the evening of November 21. The petition also states that on January 10 and 11, 2024, Nasrinbanu Takhtiwala as well as the minor girl and her father were taken to Gandhinagar for questioning. , where they were “interrogated orally as well as using a machine”.
